			<content:encoded><![CDATA[<p>Starting January 2012, plaintiffs can use ORS 20.080 to settle cases up to $10,000.</p>
<p>What happens is this- in the most common cases a person is in an auto  collision, or has vehicle damage where the value of the entire case is  less than $10,000.  Given what juries are awarding these days, many  cases fall into this realm.  A demand must be sent both to the driver of  the at-fault vehicle and their insurance company.  I send medical  records and billings to the insurance company only.  Then we wait for 30  days.  If the insurance company comes in with a decent offer, then we  settle and it’s a contingent fee.  But, if the insurance company comes  in with a lower offer than we (attorney and client) think the case is  worth, we file the case.  Defendant must beat that offer at arbitration  or trial, or risk paying attorney fees from the date the client walked  into the office.  The client then receives the entire award or judgment.</p>
<p>This statute is intended to settle the “small” cases in Oregon because the defendant could take a very big hit on attorney fees.</p>

			<content:encoded><![CDATA[<p>Thank you for seeing our ad in Metro Parent!  Both my mom and I are parents and while my mom had kids pre-magazines (ha!)  I have always enjoyed Metro Parent.  When we got the opportunity to share our fabulous will price with other parents, we jumped at the chance!  Here is the procedure for wills:</p>
<p>We charge charge $300 for a will.  If the will  is mutually similar, for example if a married couple (or any couple) is  giving the same items to eachother, then the two wills are $300.</p>
<p>Please contact our office for the will questionnaire.  This  questionnaire will get you oriented to the type of decisions you need to  make.  Please return the questionnaire with $300.  Only then can we  begin drafting your will.</p>
<p>We will then send you a draft of your will.  If you have any questions, it&#8217;s best to for us to answer them then.</p>
<p>Next we schedule a will execution.  At that time you will need to  bring in one witness (generally Elizabeth acts as one witness and  Theresa as notary).  This witness cannot have taken in your will!  If  you cannot find a friendly neighbor (or pastor or friend) then we can  work on a time when there are other people in the office who can  witness.</p>
<p>A will service can also contain an Advanced Directive and/or Power of  Attorney.  These documents are not necessary to the will and can be  found at Stevens-Ness Legal Publishing Co. at  http://www.stevens-ness.com, 916 SW 4th Avenue, Portland, Oregon 97204,  503.223.3137.</p>

			<content:encoded><![CDATA[<p>It’s an exciting honor!  Theresa M. Kohlhoff was elected by her peers to be on the Board of Governors of the Oregon State Bar, the entity that fulfills the executive functions of the bar, determines its general policies and approves its budget.  Her term will run from January, 1212 through December, 2015.  The bar exists, in part, to advance the science of law and to improve the administration of justice.  She will begin her orientation on November 17th.  One of the benefits we anticipate for the clients of Kohlhoff &amp; Welch will be the connections made with other lawyers all through the state.  We will be better informed and made more creative by these associations.  It’s a huge commitment but given the stakes today for the court system and the jury trial in particular, it’s where we should focus.</p>

			<content:encoded><![CDATA[<p>I&#8217;ll be there, sure that if only I had done one more 20 mile run, gone up more hills, lifted a few more weights, gotten up at 4:30AM instead of 5AM to train, had a tiny bit more of a positive and/or fighting attitude, I would qualify for Boston today and/or get over the finish line a little faster this year.  Shot and then wait to go over the start line.  Taiko drummers.  Guys peeing on the wall about a mile out for no apparent reason.  Up a little hill, back down Naito Parkway, then long out and back before hitting NW PDX.  Highway 30 stretches a lot further than you think before you go over the St. John&#8217;s Bridge.  Belly dancers.  Smiling UP students handing out some form of hydration.  Steel Bridge, peeing wall, and then Naito Parkway.  Heading home, knowing it&#8217;s going to happen.  The fat Viking lady is singing before turning the corner in front of the Justice Building.  I try to empty out the very last bits of energy I possess so it appears that I have flashed over that finish line.  I bend my head a bit to get my medal and catch the smile of my husband, Mike, who always finds a way to shoehorn himself where he can be the first to congratulate me.  Ice cream, oranges, and water, water, water.  I&#8217;m a human salt lick.  I won&#8217;t qualify for Boston, of course, but I will be entirely happy with myself, and grateful to have done the marathon one more time.  (Theresa, the mother in this mother/daughter partnership.)</p>

			<content:encoded><![CDATA[<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 16.0px 'Times New Roman'; color: #410242;">What does it cost for legal advice when someone dies?  I sit down on an initial consultation of 45 minutes for $150, if it turns out there is nothing further you need to do with a lawyer.  In other words, if due to the nature of the assets and the bills, you can take care of everything on your own, then this is the time and cost to set you in the right direction.  The fact that the decedent did or did not die with a will is not determinative on what, if anything needs to be done when a person dies.  A will is helpful to give one’s property at death, especially if it a different plan than what the law would otherwise provide.  But it is not a silver bullet so that if you have one, you simply distribute, pay no taxes, and avoid the state from taking the children and all the money.</p>

<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 16.0px 'Times New Roman'; color: #410242;">If it turns out that you need a lawyer to assist in a small estate affidavit, I can help where needed and the rate is $350 @ hour.  Last year I helped a man file and administer one of these and the cost to the estate was $1,200.</p>

<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 16.0px 'Times New Roman'; color: #410242;">If you do need a probate, then I don&#8217;t get paid until the end and then only by court order. Court costs, bonds, publication fees, etc&#8230;for a probate, as opposed to attorney fees, are paid by the client as we go along.  They are reimbursed by the estate to the client at least before the close of the probate.  Attorney fees are often highly overestimated:  everyone has heard of the lawyer who basically got the whole estate, alla Charles Dickens.  Well, that didn’t happen in Oregon, if it happened anywhere.  Generally, a probate without any outside litigation will run about $4,000 to $7,000:  it all depends on the amount of time and the complexity of the issues.  On the other hand, the costs to others are more than most imagine.  The filing fee to the State of Oregon is based on the county where the probate is filed and the amount of the estate.  So for example, in Multnomah County, the filing fee is $457 for estates below $500,000, the cost of publication in the Daily Journal of Commerce is $134, the cost of a final accounting for the same below $500,00 estate is $100, etc..  If there is no will, the court very often requires bonding which is an amount that depends on a number of factors including the size of the estate, the type of assets and the personal representative.  Recently a woman was assessed a bond premium of $1,200 for an estate of about $380,000.</p>
