US District Court Judge recently concluded that Measure 37 waivers were valid and enforceable.
In Citizens for Constitutional Fairness v. Jackson County, CIv. No. 08-3015 (filed November 12, 2008) the court found that the Measure 37 waivers the plaintiffs got from the county were binding, constitutionally protected contracts between the plaintiffs and Jackson County. Alternatively he concluded that the Measure 37 waivers were final quasi-judicial orders, and that Measure 49 could not rescind the waivers without violating separation of powers.
